Recruitment Agreement

This Agreement for Recruitment Services ("Agreement") is made and entered into as of the date assigned, by and between: The Trustee for the Bigley Family Trust T/A Bigley ("Recruitment Company"), having its principal place of business at 190 The Esplanade, Indented Head VIC 3223, and the client ("Client"). Collectively referred to as the "Parties." 1. Services The Recruitment Company agrees to provide recruitment services to the Client, which include sourcing, screening, and presenting suitable candidates for the Client's vacant positions ("Services"). 2. Fees 2.1 Placement Fee The Client agrees to pay the Recruitment Company a placement fee of ten percent (10%) of the candidate's first gross equivelant annualised remuneration package plus GST ("Placement Fee"). This amount includes super contributions and vehicle allowance. Placement Fee is payable within seven (7) working days of the candidate's commencement date with the Client. 2.2 Set-Up Fee The Client agrees to pay the Recruitment Company a non-refundable set-up fee of five hundred dollars ($500) ("Set-Up Fee") upon signing this Agreement. The Set-Up Fee is payable within seven (7) working days from the date of this Agreement. 3. Payment Terms All payments shall be made by the Client to the Recruitment Company within seven (7) working days of receiving an invoice. 4. Replacement Guarantee In the event that a candidate placed by the Recruitment Company resigns or is terminated for cause within 3 months of their start date, the Recruitment Company will provide a replacement candidate at no additional cost to the Client, provided that all fees have been paid in accordance with this Agreement. 5. Confidentiality Both Parties agree to keep all information regarding candidates, including resumes and personal details, confidential and not to disclose any such information to third parties without the prior written consent of the other Party. 6. Term and Termination This Agreement shall commence on the date of the engagement and shall continue until terminated by either Party with thirty (30) days' written notice. In the event of termination, the Client shall pay the Recruitment Company for all Services rendered up to the date of termination. 7. Governing Law This Agreement shall be governed by and construed in accordance with the laws of Victoria. 8. Entire Agreement This Agreement constitutes the entire agreement between the Parties and supersedes all prior agreements, understandings, and negotiations, whether written or oral, relating to the subject matter hereof. 9. Amendments No amendment or modification of this Agreement shall be valid unless in writing and signed by both Parties. These Terms and Conditions are between The Trustee for the Bigley Family Trust T/A Bigley ABN xxxxxxxx and the Company and their legal representatives, successors and/or assigns (“you/your”), and specify the terms upon which we will provide services to you until new Terms and Conditions are notified to you in writing. 10. Acceptance The acceptance of candidate details or interviewing of a candidate or engagement of a candidate introduced by us will amount to your acceptance of the Terms and Conditions. No variation can be made to these terms without the written consent of a Director of Bigley Recruitment.
